Terms & Conditions of Sales
By placing a purchase order via www.p-shop.hk, you shall be deemed to have accepted and willing to be legally bound by the terms and conditions set-forth here-in. You must NOT use our online sales services if you do not agree to and/or accept any of these terms and conditions.
1.1 "CS" means CS (HK) Company Limited, and shall be referred as "we", "our" and/or "us" hereafter.
1.2 "Product(s)" means products, spare parts, accessories, and/or consumables of Philips branded products sold in this Website.
1.3 "Online Sales Service(s)" means any online sales services provided by CS in this Website.
1.4 "Customer(s)" means your good self, who access and/or place purchase orders via this Website, and shall be referred as "you", "your" and/or "yours" hereafter.
1.5 "Order(s)" means selected Products you intended to purchase via this Website.
1.6 "Contract" means terms and conditions agreed by us and you for sales of Products by us and purchase of Products by you.
1.7 "Website" means www.p-shop.hk.
2. Formation of Contract
2.1 No information in this Website constitutes an offer of any kinds by us.
2.2 Notwithstanding any notices generated by the system, acceptance of your Order shall be at our own discretion and subject to availability.
2.3 A Contract is formed when confirmation notice is issued to you by us via email.
2.4 Order confirmation email shall be issued to you within three (3) working days. If you did not receive any notifications by then, please contact our customer service department by phone at (852) 2741 8160 or by email: email@example.com.
3. Price & Payment
3.1 Price of Products shall be as stated in this Website as at the date and time you placed the Order.
3.2. All prices are in Hong Kong Dollar. Prices shall be those prices published on www.p-shop.hk at the time you submit you order. The prices published on www.p-shop.hk are exclusive of delivery fee. Delivery costs will be calculated separately as applicable and specified on the order form and added to the total price of the order.
3.3 You shall settle payments using VISA, Master, UnionPay, AliPay and WeChat Pay at the time of check out.
4.1 We provide two delivery options:
a) Domestic Delivery for products, spare parts, accessories, and/or consumables of Philips branded products and
b) Collection at specified Philips Authorized Consumer Care for spare parts, accessories, and/or consumables of Philips branded products.
4.2 CS shall use reasonable endeavors to deliver the ordered Products to Customer. CS shall not be liable for any loss of profits or business, or any other direct, indirect, special, incidental or consequential damages due to late delivery or non-delivery of Products.
4.3 In order to protect Customers' interest, you are required to present invoice upon delivery and/or collection of your Orders. We reserve our rights to reject delivery and/or collection if Customer failed to present relevant documents.
4.4 Domestic Delivery
4.4.1. Free domestic delivery is provided for the purchase orders over HK$1,000.
4.4.2. Delivery costs, where applicable, are payable by you as indicated on your invoice.
4.4.3. Our customer service personnel and/or courier agent shall contact you by phone or email for delivery arrangement after order confirmation. If you did not receive any phone calls or email by then, please contact our customer service team by phone at (852) 2741 8160 or by email: firstname.lastname@example.org.
4.4.4. We reserve our rights to cancel your Order if we cannot contact you for delivery arrangement over thirty (30) days without any prior notices.
4.4.5. Delivery service is available to Hong Kong Island, Kowloon, the New Territories and Tung Chung, but excluding restricted areas, Outlying Islands, Ma Wan and Discovery Bay.
4.4.6. No delivery service is provided to hotel and/or P.O. Box addresses.
4.5 Collection at specified Philips Consume Care Centre
4.5.1. You shall receive an email notification to confirm collection of your Order. If you did not receive any email by then, please contact our customer service team by phone at (852) 2741 8160 or by email email@example.com.
4.5.2. You are required to specify the selected authorized consumer care centre when placing order. The address and service hour of respective consumer care centre will be shown on your order.
4.5.3. We reserve our rights to cancel your Order if you failed to pick up the Products over thirty (30) days without any prior notices.
4.6 In the event you order various Products to be delivered to different addresses, you will need to submit a separate order form for each delivery address. Any delivery or shipment dates indicated are best estimates only and CS shall not be liable for any loss, damage, costs or expenses for failure to deliver in accordance with the delivery or shipment dates given. In the event any of the products ordered is out of stock, this may mean the whole order is delayed.
4.7. Upon delivery of the Products to the courier, CS will send you a confirmation of shipment by email provided have registered an email address on the order form.
5.1 Products shall be deemed to have been accepted in good conditions by you unless notices were brought to our attention by phone, fax and/or email within seven (7) days of delivery and/or collection.
5.2 We shall, at our own discretion, repaired and/or replaced the Product if defective was found after inspection and/or verification.
5.3 You are required to present original receipt and/or delivery note of the Product for repair and/or replacement process. We reserve our rights to reject repair and/or replacement if you failed to present relevant documents.
6. Title, Risk of Damage or Loss
6.1 Title and risk of damage or loss of the Products shall pass to Customer upon delivery of Products to the address appointed by the Customer in the Order.
7.1. The warranty policy of the Products is set according to the warranty card supplied with the Product and as/or as may be stated on the official Philips Web Site.
7.2. Unless specified, no warranties are provided for the spare parts, accessories, and/or consumables of Philips branded products sold in this Website.
8.1 Any Orders confirmed with payments made via Visa, Master, UnionPay, AliPay, WeChat Pay are refundable / exchangeable ONLY within 7 days after delivery / collection. The refund/exchange is valid ONLY when the Product is in salable condition with the original packaging, including manuals, parts and your original receipt or packing slip.
8.2 The shipping fee is non-refundable.
8.3 The refund/return must be processed in person in specific Philips Authorized Consumer Care Centres.
9.1 You agree and warrant that Products are purchased for your own use only, not for resale. We shall, at our own discretion, refuse to accept Orders which were suspected to be placed for resale purpose.
9.2 You undertake not to reproduce, duplicate, copy, sell, resell or otherwise exploit for any commercial purposes, any portion of the Services, use of the Services, or access to the Services.
10.1 You agree to indemnify and hold us harmless form and against all liabilities, claims, fines, losses, damages, costs and expenses (including reasonable attorney's fees) whether direct or indirect, arising from, related to or in connection with (i) the inaccuracy made by you, (ii) any willful or negligent act, failure to act, error or omission by you in relation to the Online Sales Services, and/or (iii) any applicable law or regulation breached by you.
11. Governing Law
11.1 Terms & Conditions shall be governed by and construed under the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.
11.2 Both parties agree to submit these Terms & Conditions to the jurisdiction of the courts of the Hong Kong Special Administrative Region of the People’s Republic of China.
12.1 In the event that any provision of this Terms & Conditions becomes or is declared by a court of competent jurisdiction or competent governmental authority to be illegal, unenforceable or void, other Terms & Conditions shall continue in full force and effect without said provision.
13. Force Majeure
13.1 CS shall not be liable to any failures and/or delays in performance of our obligations caused by acts of God, acts of terrorism, outbreak of hostilities, riot, civil disturbance, acts of any government or authority (including revocation of any licenses or consents), fire, explosion, flood, fog or bad weather, default of suppliers or subcontractors, theft, malicious damage, lockout or industrial action of any kinds, any causes or circumstances whatsoever not reasonably foreseeable and/or beyond our reasonable control.
14. Change of Terms & Conditions
14.1 CS reserves the right to change the terms & conditions without prior notice.
15.1 Products and/or Online Sales Services provided in www.p-shop.hk might not be available to all persons.
15.2 Information might only be available in English or Chinese.
15.3 Information stated in the Website is for your reference only and is provided on an "as is" basis without warranty of any kind and may be changed, revised and/or modified without any prior notices.
